When using force in self-defense, New York State does not allow use of deadly force by ordinary citizens even when in his or her own home or business. Duty to retreat is required.
As evidenced by video of Jose Alba, he retreated yet he is criminalized. “Duty to Retreat” must be removed to stop wrong interpretation of state’s Penal Code.
Also wrong is Austin Simon’s girlfriend (not named in the media) for not paying $3 for snacks and for stabbing Jose Alba’s arm three times with a knife (justified self-defense?).
Laws are meaningless if not enforced or wrongly interpreted.
